TERMS AND CONDITIONS

FAST LANE AUCTIONS, LLC

These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.fastlaneauctions.com (the “Website”) and your participation in auctions conducted through the Website.

By registering, bidding, or otherwise using the Website, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, any applicable Seller Auction Terms, and the Privacy Policy.

1. PARTIES AND ROLES

1.1 Auction Company

Fast Lane Auctions, LLC (“Fast Lane,” “we,” “us,” or “our”) operates an online auction platform and conducts auctions through a Georgia-licensed auctioneer. Fast Lane is an auction company and does not own vehicles offered for sale.

1.2 Sellers

Vehicles are offered by independent third-party sellers (“Seller”), including towing and impound companies. Sellers are solely responsible for vehicle ownership or lien authority, title matters, court orders, deposits, payments, fees, storage, pickup, and vehicle condition.

1.3 Buyers

“You,” “Buyer,” or “Bidder” refers to any individual or entity registering for or participating in an auction through the Website.

2. INCORPORATION OF SELLER TERMS

Each auction listing may include Seller-specific auction terms (“Seller Auction Terms”).
Seller Auction Terms are incorporated into these Terms by reference and control all Seller-specific matters, including:

  • deposits and forfeitures

  • payment methods and deadlines

  • storage, late, and administrative fees

  • pickup and removal requirements

  • title, lien, or court-ordered sale procedures

  • vehicle condition and disclosures

If a conflict exists, Seller Auction Terms control for that Seller’s auction.

3. AUCTION PLATFORM & AUTHORITY

Fast Lane is responsible for:

  • hosting and maintaining the auction platform

  • bidder registration and account management

  • auction scheduling and bid integrity

  • enforcing uniform bidding rules

Fast Lane does not:

  • own vehicles

  • guarantee title or registrability

  • certify vehicle condition

  • act as the seller

4. REGISTRATION & ELIGIBILITY

To bid, you must:

  • be at least 18 years old

  • provide accurate registration information

  • provide valid payment information

  • comply with all applicable laws

Fast Lane may deny, suspend, or revoke access at its discretion.

5. BIDDING TERMS

  • All bids are binding and irrevocable

  • Bids may not be canceled or retracted

  • Winning bidders are obligated to complete payment in accordance with Seller Auction Terms

  • You are responsible for all activity on your account

Fast Lane may void bids to correct errors, prevent fraud, or protect auction integrity.

5.X CREDIT CARD AUTHORIZATION, LIQUIDATED DAMAGES & CHARGEBACK WAIVER

By registering to bid and providing a credit card, you expressly authorize Fast Lane Auctions, LLC to obtain a pre-authorization and/or charge to your credit card for bidder deposits and liquidated damages as described in these Terms and the applicable Seller Auction Terms.

You acknowledge and agree that:

  1. Authorization at Registration
    You knowingly provide your credit card for bidder verification, auction participation, and enforcement of auction obligations.

  2. Not a Vehicle Purchase Charge
    Any charge made by Fast Lane Auctions, LLC is NOT payment for a vehicle.
    Such charge represents contractual liquidated damages arising from failure to perform.

  3. Trigger for Charge
    You authorize Fast Lane Auctions, LLC to charge your credit card without further notice if you:

    • place a winning bid and fail to complete payment;

    • violate payment or auction terms;

    • otherwise breach these Terms or Seller Auction Terms.

  4. Reasonableness of Damages
    You agree that liquidated damages are a reasonable estimate of actual damages, are not a penalty, and are difficult to precisely calculate at the time of breach.

6. DEPOSITS, PAYMENTS & FEES

Deposits, registration fees, payment methods, deadlines, forfeitures, storage fees, and late fees are set by Sellers and disclosed in Seller Auction Terms.

All deposits and damages are subject to Section 5.X – Credit Card Authorization and Chargeback Waiver.

7. VEHICLE CONDITION – NO WARRANTIES

ALL VEHICLES ARE SOLD “AS IS, WHERE IS”, WITH NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Vehicle descriptions, photographs, and documents are provided for convenience only and are not guarantees.

8. TITLE, LIEN & COURT-ORDERED SALES

Some vehicles are sold pursuant to Georgia Title 40 lien or court-ordered procedures by Sellers.

Fast Lane:

  • does not own vehicles

  • does not guarantee title issuance

  • does not represent registrability in any jurisdiction

Buyers are solely responsible for confirming title eligibility.

9. DERELICT / PARTS-ONLY VEHICLES

Vehicles designated as derelict or parts-only:

  • are sold for parts only

  • receive Bill of Sale only

  • may never be titled or used on public roads

10. REMOVAL & TRANSPORT

Buyers are responsible for vehicle removal, towing, transportation, and compliance with all laws within Seller-specified timeframes.

11. PROHIBITED CONDUCT

You agree not to:

  • manipulate bids or collude

  • submit false documentation

  • engage in title fraud or title skipping

  • misuse the platform

Initiating an unauthorized or bad-faith chargeback in violation of these Terms constitutes prohibited conduct and may result in permanent banning.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Fast Lane is not liable for indirect or consequential damages

  • Fast Lane’s total liability is limited to fees paid to Fast Lane, if any

13. INDEMNIFICATION

You agree to indemnify and hold harmless Fast Lane from claims arising from:

  • your bids or purchases

  • violation of these Terms or Seller Auction Terms

  • misuse of the Website

14. INTERNET & SYSTEM INTERRUPTIONS

Fast Lane is not liable for service interruptions, technical errors, or transmission failures.

15. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Georgia.
All disputes shall be brought exclusively in Fulton County, Georgia.

16. MODIFICATIONS

Fast Lane may modify these Terms at any time. Continued use constitutes acceptance.

17. ENTIRE AGREEMENT

These Terms, Seller Auction Terms, and the Privacy Policy constitute the entire agreement between you and Fast Lane.
